Foundations of Islamic Legal Theory (Al-Waraqat)

This course covers Al-Waraqat, a renowned classical text authored by Imam Al-Haramayn on Usul al-Fiqh, the science of Islamic legal theory. Al-Waraqat is a foundational text that outlines the principles and methods used by Islamic scholars to derive legal rulings from the Quran and Sunnah. In this course, students will delve into the science of understanding Islamic evidences, legal reasoning, and the structure of Islamic law, enhancing their grasp of the core methodologies that shape Islamic jurisprudence.

What Students Will Learn

• The fundamental principles of Usul al-Fiqh (Islamic Legal Theory).

• How scholars derive legal rulings from primary sources like the Quran and Sunnah.

• The types of evidences (proofs) in Islam and how they are applied in the legal framework.

• The methodology behind deducing Islamic rulings and its historical development.

• Key concepts such as Ijma’ (consensus), Qiyas (analogy), and their role in the Islamic legal system.

• The process of legal reasoning used by classical scholars and how it remains relevant in contemporary Islamic jurisprudence.

Instructor:

Khalid Hassan is a graduate of the faculty of Sharee’ah, Qassim University In Saudi Arabia. He has studied under well known scholars such as Shaykh Khalid al-Mushayqih who is a student of Shaykh Uthaymeen Rahimahullah. He teaches Islamic Studies & Arabic at Madinah College and has delivered several talks at many universities and masaajids.
